If you have children, you must consider what will happen to them and to your property and possessions should you experience an incapacitating illness or meet an untimely death. Do you have a legal plan in place or will the state determine how your assets will be distributed and with whom your children will live?
Estate Planning - Before you die or are incapacitated
When you meet with a lawyer at Reeves and Ross, P.C., we will discuss how to best protect your assets, reduce or eliminate taxes, and provide for your family. We know there are many tools used to create customized estate plans, and we can work with you to select the best combination of the following:
- Wills - This is the basic estate-planning instrument and it determines how assets will be distributed.
- Trusts - Having a trust helps to avoid the costs and delays associated with the probate process, and it provides a greater privacy advantage than using only a will. There are many types of trusts including living, special needs (to take care of disable person) and testamentary trust. With a trust, you can determine at what age your child receives assets.
- Powers of Attorney - A power of attorney specifies who will make important decisions on your behalf if you ever become physically or mentally unable to handle your affairs.
- Living Will - This tool will memorialize your wishes and desires regarding specific medical treatment, should you be unable to make those decisions. By creating a living will, you can remove some of the stress your loved ones would face when having to make the difficult life-saving or life-sustaining decisions for you.
- Health Care Directive - If you want to specify exactly what you want done in certain medical situations, you will need to complete a health care directive. This tool also names a specific third party to make decisions in accordance with your wishes.
Medicaid Planning - This involves planning in advance for loved ones who may be anticipating going into a nursing home to protect and preserve their assets.
Estate Administration - Once your loved one has died
The attorneys at Reeves & Ross, P.C., understand the wide range of emotions that family and friends encounter upon the death of a loved one. We want to ease the difficulty of this time for you as much as possible by providing assistance with the legal ramifications involved, such as:
- Preparing inheritance and estate tax forms

- Verifying that debts are paid
- Confirming that the estate is distributed in accordance with the wishes of the deceased
- Addressing legal matters that may arise (will contestation, objections resulting in litigation)
